Overview:
The health sector has long had to deal with
the complexity of HIPAA’s privacy and security rules, and as of February’s
stimulus act, so must anybody that receives health data from them.
Accountants, law firms, consultants, and many other service providers must
now also ensure that they have robust records management programs that meet
HIPAA’s privacy and security standards.
Those that choose to ignore that they have
health care data face both reputational and financial harm. Serious breaches
of the privacy or security of health data require the notification of
individuals, regulators, and the media. Additionally, failure to maintain
HIPAA compliant controls over the security, use, and disclosure of records
can result in substantial investigation and penalties.
Finally, because HIPAA sets high standards for
privacy and security, it's requirements should be considered in any records
management program, where it can help satisfy other regulations over the
receipt, retention, and release of personal data.
During this session, Greg Pemberton, an
attorney at Iron Mountain and frequent speaker on issues of information
regulation, will clearly explain:
1) The broad reach of HIPAA
2) HIPAA's privacy and security requirements for health data records
3) The privacy and security breach notification obligations
4) The new enforcement scheme
5) The potential penalties
Biography:
Greg Pemberton, Esq. has
more than 15 years of experience in technology, law, and information
management. As Corporate Counsel & Manager, Privacy & Compliance for Iron Mountain, he provides counsel on worldwide
information regulation, and specializes in data transfer and personal
information privacy and security. In prior roles, he was Director of the
video game industry's Privacy Online Program, and worked at the Michigan
AG’s High Tech Crime Unit and EPIC, the privacy rights organization. He is
a Certified Information Privacy Professional in both the US and Canada.
