Daniel K. Gelb, Gelb & Gelb, LLP

Dan Gelb is an attorney with Gelb & Gelb LLP in Boston, Massachusetts where he represents clients in federal and state court litigation, arbitration and regulatory proceedings. Dan concentrates in the areas of business, securities, non-competition agreements, corporate raiding and trade secrets, accountants' liability and criminal law. Prior to joining Gelb & Gelb LLP, Dan was an Assistant District Attorney with the Norfolk County District Attorney's Office in Massachusetts. Dan chairs the Massachusetts Bar Association Civil Litigation Section's E-Discovery Practice Group, he is a member of the National Association of Criminal Defense Lawyers' E-Discovery Task Force, and The Sedona Conference's Working Group on Electronic Document Retention & Production. He is also an Advisory Board Member of BNA, Inc.'s White Collar Crime Report.

 

Eric P. Magnuson, Nutter McClennen & Fish LLP

Eric P. Magnuson is a partner in the litigation department and a member of the firm's Hiring Committee.  His practice encompasses a wide range of commercial-litigation disputes, including those involving insurance, bankruptcy, contract, business torts, unfair-trade practices, partnership, business valuation, non-compete covenants, commercial lending, and director-and-officer liability.  He has substantial experience analyzing and litigating damage/remedy issues.

 

Eric has experience in all stages of the litigation lifecycle—pretrial, trial, and appeal—in state and federal courts.  Representative matters include:

  • Co-chairing a month-long jury trial involving multi-million dollar claims for lost profits arising out of a real-estate partnership dispute.

  • Second-chairing a multi-day arbitration involving disputes over shareholder agreements and development of intellectual property.

  • First-chairing an asylum case before the United States Immigration Court.

  • Defending a Fortune 50 company against a $20 million claim for alleged breaches of fiduciary duty and receipt of preferential/fraudulent transfers.

In addition to representing private litigants, Eric has represented state government as a Special Assistant Attorney General.

Eric is a member of the Firm’s Data Discovery & Management Group and participated on the advisory board of an electronic-discovery service provider.  He advises clients and attorneys on litigation holds, e-data collection/production, and document-retention policies.
 

Eric served as executive-note editor for the Arizona Law Review.

ARMA Boston, Simmons College GSLIS and the Sedona Conference have joined forces to bring you a terrific 4 part series on Ediscovery. This last fourth part of the series will cover a mock hearing that will illustrate electronic discovery issues. The hearing will include a judge, defense and plaintiff counsel, and a records manager witness.
